A 5.0 G.P.A. Student of Modibbo Adama University of Technology (MAUTECH), Yola dies

This post is in honour of Miss Peace Kenneth; from Akwa Ibom state. Until her death, Peace Kenneth was a student of Modibbo Adama University of Technology (MAUTECH), Yola; formerly known as Federal University of Technology, Yola (FUTY). She was a student in department of Information Technology with 5.0 G.P.A. In fact, history has it that she was the first to make such an excellent academic record in the department of Information Technology since the school came into existence. She was so caring, loving,
and confident in pursuit of her academic goals. She died after a brief illness. The shocking news of her death went viral on the Students Union Government, MAUTECH Facebook Page on 20th December, 2014.
What a great loss to the Nigerian society and the world at large! We miss her.
The Success Minds Crew wishes her gentle soul enternal rest in the bossom of the Lord. May God grant her parents, relatives, friends and well wishers the courage to bear the irreparable loss.

Difference between motion exparte and motion on notice

Both are interlocutory injunctions sought by way of applications (prayer) before the court; but they serve different purposes. Motion exparte which is interpreted as 'on one party' is an application before the court in time of urgency; to restrain from doing an act which may cause an irreparable injury to the applicant. The order subsists pending the final determination of the suit. Eg. If the subject matter of the suit is a an economic tree, and the defendant intends to cut the tree because he claims it belongs to him, the plaintiff can apply for a motion exparte for court to stop the Defendant from cutting the tree until the suit is determined. It is an exception to the rule of fair hearing enshrined in the constitution. So, the Defendant need not be served provided the Plaintiff can convince the court that waiting for the Defendant to be served will occasion an irreparable injury on him as the Defendant may cut the tree before service is effected on him.
